Terms of service

The terms for using e-invoices.it, with and without an account, and the agreement on the processing of the personal data contained in the invoices you upload.

1. The service

e-invoices.it, operated by Thomas Tschager (VAT no. IT03240910210, legal notice), converts FatturaPA electronic invoices into readable documents, attachments, Excel summaries and dashboards. The service is intended for professionals, businesses and those who keep their accounts.

2. Use with and without an account

• Without an account you can process up to 20 invoices at a time, with a limit on requests per IP address.
• With an account, created with the login link sent to your email, the per-request limits do not apply. You are responsible for access to your email: anyone who can read it can access your account.
• The service is currently free of charge. If we introduce paid services in the future, prices and terms will be shown before any purchase and nothing will be charged without an explicit order from you.

3. Acceptable use

You may only upload invoices that you have the right to process. You may not use the service for unlawful activities, circumvent the limits, overload it or attempt to access other people's data. In these cases we may block access or the account.

4. The results

The conversion is designed to reproduce faithfully the data contained in the XML files, but it may contain errors. The document with tax validity remains the XML file transmitted through the Sistema di Interscambio (SdI): the readable version, the Excel file and the dashboard are tools for consultation and analysis and replace neither legally compliant archiving (conservazione a norma) nor the advice of a professional. Check the results before using them for tax compliance. To the extent permitted by law, we are not liable for incorrect calculations, misleading representations in the dashboard or other damage caused by bugs or errors in processing the uploaded invoices, except in cases of wilful misconduct or gross negligence (see section 6).

5. Personal data in invoices: data processing agreement (Art. 28 GDPR)

The invoices you upload may contain personal data of third parties. For these data you, or the company on whose behalf you act, are the controller; e-invoices.it processes them as processor, on the following terms:

• Subject matter and duration: only the conversion you request, for the duration of the processing.
• Instructions: the data are processed only to produce the requested result and return it to you, never for other purposes.
• Retention: the files are deleted once processing is complete; nothing of their content is retained.
• Confidentiality and security: the transfer is encrypted (HTTPS), processing takes place on servers in the European Union, and access to the servers is restricted to the provider.
• Sub-processors: for hosting we use providers with servers in the European Union, bound by the same data protection obligations. You authorise us to choose and replace them; any changes are shown on this page.
• Assistance: since the service does not retain the files or their content, we hold no data with which to respond to data subject requests (access, rectification, erasure and the like), which remain the responsibility of the controller. Any personal data breach will be notified without undue delay by a notice published on this site.
• Audits: the service is automated, identical for everyone and does not retain the files or their content, so there is no individual processing to audit. The information demonstrating compliance with these terms is that published in these terms, in the privacy notice and in the public code analysis report; no individual audits or individual responses are provided. The powers of the supervisory authorities remain unaffected.

6. Availability and liability

The service is provided free of charge and "as is", without any warranty of accuracy, completeness or fitness for a particular purpose. We do our best to keep it available and correct, but we cannot guarantee that it will always be reachable or free of errors, and we may modify or suspend it. To the extent permitted by law, we are not liable for damage resulting from the use of the results or from the unavailability of the service, nor for indirect damage such as loss of profits, penalties, interest or consultancy costs, except in cases of wilful misconduct or gross negligence (Art. 1229 of the Italian Civil Code). The rights granted to consumers by law remain unaffected.

7. Changes

We may update these terms; the date of the last update is shown at the top. Changes relevant to accounts are communicated by email before they take effect.

8. Governing law and jurisdiction

Italian law applies. For disputes with professionals and businesses, the courts of Bolzano have jurisdiction; for consumers, the courts of the consumer's place of residence or domicile.
